Copyright and Rights

All other trademarks not owned by Segreti Sabaudi that appear in any Regia Compagnia Services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Segreti Sabaudi or the Regia Compagnia.

License to Access Segreti Sabaudi Services

Provided that you comply with these Terms and Conditions of Use, the Terms of Service, and pay any applicable fees, the Regia Compagnia or its content provider grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal use of the Segreti Sabaudi Services. You may not use any meta tags or any other “hidden text” utilizing the Regia Compagnia’s name or trademarks without its express written consent. You may not misuse the Segreti Sabaudi Services. You may use the Regia Compagnia’s services only as permitted by law. Any breach of these Terms and Conditions of Use or the Terms of Service will result in the revocation of the authorization or license granted by the Regia Compagnia.

Personal Account

You may be required to use your Segreti Sabaudi account to use certain Segreti Sabaudi services by logging in and having a valid payment method associated with it. If there is an issue charging the designated payment method, the Regia Compagnia may charge any other valid payment method associated with your account. By using Segreti Sabaudiservices, you are required to keep your account and password details confidential, control access to your computer and devices, and accept—within the limits permitted by applicable law—that you are responsible for all activities carried out using your account and password. You must take all necessary precautions to ensure that your password remains secure and confidential and must inform the Regia Compagnia immediately if you have reason to believe that a third party is aware of your password or that it is, or is likely to be, used without authorization. You must ensure that the information you provide is accurate and complete and promptly communicate any changes to the information provided. You can access your information in the “My Account” section of the website. You may not use Segreti Sabaudi services in any way that causes, or may cause, interruptions, damage, or malfunctioning of Segreti Sabaudi services and their features; for fraudulent purposes; to engage in illegal activity; or to cause annoyance, inconvenience, or anxiety. The Regia Compagnia reserves the right to prevent access to Segreti Sabaudi services or to close your account where your conduct constitutes justified grounds to do so; in particular, in the event of a breach of applicable law, applicable contractual provisions, or the Regia Compagnia’s guidelines or policies, all of which are available on the Segreti Sabaudi website. Despite any such restriction or closure, you may continue to access content and services purchased up to that time.

Reviews, Comments, Communications, and Other Content

You may post reviews, comments, and other content, and submit communications and suggestions, ideas, comments, questions, or other information, provided that the content is not unlawful (obscene, abusive, threatening, defamatory; that it does not violate privacy or intellectual property rights; or is otherwise offensive or objectionable toward the Regia Compagnia and/or third parties) and does not contain viruses, political propaganda, commercial solicitation, chain letters, mass emails, or any other form of spam. You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any content. The Regia Compagnia reserves the right to remove or edit such content. By posting customer reviews, comments, customer questions, or customer answers, you grant the Regia Compagnia a non-exclusive, royalty-free license to use, reproduce, publish, make available, translate, and modify such content worldwide (including the right to sublicense to third parties) and the right to use the name submitted in connection with such content. Moral rights remain unaffected. You may remove content from public view or, where available, adjust settings so that content is visible only to those granted access. By posting content in a Segreti Sabaudi Service, you represent and warrant that you own or otherwise control all rights to the content you post and that it does not conflict with any applicable Regia Compagnia policies or guidelines, and that such use will not cause harm to third parties. Subject to cases where liability may arise from a failure to remove unlawful content after receiving notice, you agree to indemnify the Regia Compagnia from all legal actions brought by third parties against the Regia Compagnia arising from or connected with the content and materials you provide.

Liability

The Regia Compagnia will do its best to ensure that access to Segreti Sabaudi services is uninterrupted and that transmissions are error-free. However, due to the nature of the Internet, uninterrupted access and error-free transmissions cannot be guaranteed. Access to Segreti Sabaudi services may also occasionally be suspended or restricted to allow for repairs, maintenance, and the introduction of new activities or services. The Regia Compagnia will seek to limit the frequency and duration of such suspensions and restrictions. The Regia Compagnia shall not be liable for losses that are not the result of a breach of these terms, or for any loss of business opportunity (including lost profits, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable at the time the customer began using the Segreti Sabaudi Services. The Regia Compagnia shall not be liable for delays or failure to perform obligations under these terms where the delay or failure results from events beyond its reasonable control (force majeure). This provision does not affect rights under applicable law, and in particular the right to receive purchased goods within a reasonable time or to be refunded in the event of non-delivery due to force majeure. The laws in some jurisdictions may prohibit the limitations of liability stated above; where such laws apply, these limitations shall not apply and you may have additional rights. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, or for willful misconduct or gross negligence.

Governing Law and Jurisdiction

These Terms and Conditions of Use are governed by and shall be construed in accordance with Italian law (excluding conflict of law provisions). You accept, and we likewise accept, the exclusive jurisdiction of the Courts of the District of the Court of Turin. Export Control

You agree not to export, re-export, or transfer any product (including software or other digital products) purchased from the Segreti Sabaudi Services to any country, individual, company, organization, or entity to which such export is restricted or prohibited by law. For example, economic sanctions and embargoes imposed by the European Union, the United Nations, the U.S. Departments of State, Treasury, or Commerce, and other governmental authorities (such as embargoes imposed on specific countries, or sanctions imposed on individuals or companies for terrorism or money laundering) may prohibit taking products, even for personal use, into other countries, and/or sending products (physically by mail or digitally by email or file sharing) to certain individuals, companies, organizations, or entities. You also agree not to purchase any product or service from the site if you yourself are subject to restrictive measures (sanctions).

Service Changes or Amendments to Terms

The customer is subject to the policies and terms of the Terms and Conditions of Use in force at the time Segreti Sabaudi services are used. If any of these terms is deemed invalid, void, or for any reason unenforceable, that condition shall not affect the validity and enforceability of any remaining conditions.

Waiver

In the event of a breach of these Terms and Conditions of Use, the Regia Compagnia’s failure to enforce its rights against you shall not constitute a waiver of the Regia Compagnia’s right to act for the breach of the customer’s obligations.

Minors

The Regia Compagnia does not sell products to minors. Minors under 18 may use Segreti Sabaudi Services only with the involvement of a parent or guardian.

GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale govern the sale of products and, where applicable, services through the site when the Regia Compagnia acts as seller (“General Conditions of Sale”). The Regia Compagnia offers a wide range of services and, at times, additional terms and conditions may apply. By using any Segreti Sabaudi service, you will be subject to the terms, guidelines, and general conditions applicable to that specific service (“Terms of Service”). In the event of a conflict between these General Conditions of Sale and the Terms of Service, the Terms of Service shall prevail.
We invite you to carefully read these General Conditions of Sale before making any purchase. By making any purchase, you fully accept these General Conditions of Sale. If the Customer is a consumer, once the online purchase procedure is completed, they will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

The Contract

To buy one or more products, you may select them one at a time and add them to your cart. Once all items you intend to purchase have been selected, you may proceed to checkout and submit the order. A summary page will then appear showing the selected products, their price, and delivery options (with the related costs). You will be asked to choose your preferred delivery, shipping, and payment method.
The order will then be considered your contractual offer to purchase addressed to the Regia Compagnia for the listed products, each considered individually. Upon receipt of the order, Segreti Sabaudi will automatically send you an acknowledgement of receipt. The order acknowledgement does not constitute acceptance of the purchase offer. By sending the order acknowledgement, we only confirm that we have received the order and have submitted it to a verification process for data and product availability. The sales contract with the Regia Compagnia will be concluded only when we send you a separate email containing shipment information and the estimated delivery date. If an order is fulfilled through multiple shipments, you may receive separate shipping confirmations. You may cancel the order before receiving the shipping confirmation, provided that the order has not been prepared for shipment; in such case, no costs will be charged. You accept to receive invoices in electronic form; these documents will be sent in PDF format to the email address provided and will be available in the tax drawer (“cassetto fiscale”). The issuance of the electronic invoice related to an order will be communicated in the shipping confirmation. The sales contract between the Customer and Segreti Sabaudi is deemed concluded in Italy and governed by law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, territorial jurisdiction lies exclusively with the Court of Turin. The Regia Compagnia shall not be held liable for delays in processing the order or delivering the ordered items. Any delivery and/or ancillary costs are borne by the customer and are clearly stated during the ordering process. Payment for the goods by the customer will be made using the method chosen at the time of ordering. No additional amounts are due by the Customer beyond the total order amount shown at the end of the purchase procedure.

Withdrawal Right, Exceptions, and Return Policy

Subject to the exceptions set out below, you have the right to withdraw from the order without providing any reason within 14 working days from when the ordered product has been shipped and/or delivered (or the last product, batch, or piece in the case of multiple goods delivered separately) or from the conclusion of the contract.
To exercise the right of withdrawal, you must send the relevant notice before the expiry of the 14-working-day period and return the product to the Regia Compagnia’s premises at Via Oropa 76, 10153 Turin. For more information on the right of withdrawal and operating instructions, contact Segreti Sabaudi Customer Service. Each bottle has its own storage history and was checked before being offered for sale by the Segreti Sabaudi Team. For bottles stored for many years, however, it is not possible to guarantee that the wine is still perfectly preserved. Segreti Sabaudi guarantees that the condition of the bottle is exactly as described and shown in the product page description and photo. Any right of the Customer to damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance, even partial, of an order.

Effects of Exercising the Withdrawal Right

All payments received in relation to the product for which the withdrawal right has been exercised will be refunded within 14 days from receipt of such product. The refund will be issued using the same payment method used to place the order, unless expressly agreed otherwise. In any case, no costs will be incurred as a result of the refund. You must return the products to the registered office of the Regia Compagnia within 14 working days from the day you communicated the withdrawal. You must bear the direct costs of returning the products. You may be held responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

 

Exceptions to the Withdrawal Right

The withdrawal right does not apply in the event of:

• Supply of sealed goods that are not suitable for return for hygiene or health protection reasons and that have been unsealed after delivery, or goods that after delivery are inseparably mixed with other goods;

• Supply of made-to-measure or clearly personalized goods; full performance of the contract;

• Supply of alcoholic beverages whose price was agreed at the time of contract conclusion, whose delivery can occur only after thirty days, and whose actual value depends on market fluctuations that cannot be controlled by the Regia Compagnia;

• Supply of goods that risk deteriorating or expiring rapidly;

• Service contracts after the service has been fully performed by the Regia Compagnia, where you expressly consent to performance and accept the loss of the withdrawal right following performance.

 

Return Policy

In addition to rights provided by law, products sold by Segreti Sabaudi may be returned to the Regia Compagnia within 14 days of delivery, subject to the withdrawal exceptions, provided they are intact and in the same condition in which they were delivered. To return a product, write to us or call us. The Regia Compagnia will refund only the purchase price paid. We will not refund the shipping costs you paid to receive the item you are returning. Transport risks and return costs are solely your responsibility. These provisions are additional and do not affect your statutory rights nor the 14-day withdrawal right described above.

 

Prices and Availability

All prices include applicable VAT as required by law. Information on product availability is listed on the site and on each product page. Beyond the information provided on the product page or elsewhere on the site, the Regia Compagnia cannot provide more precise indications of availability. Please note that estimated dispatch and delivery times are purely indicative and cannot be fully relied upon. Once the order is received, we will notify you by email if any of the ordered products are unavailable. Despite our efforts, the Regia Compagnia cannot exclude that for a small portion of the many products in the catalog, an incorrect price may be shown. Price accuracy is checked during order verification and subsequent shipment. If, due to errors or other issues, the price indicated on the site is lower than the correct sale price of a product, the Customer will be contacted to confirm whether they still wish to purchase the product at the correct price; otherwise, the Regia Compagnia may not accept the order. If the correct price is lower than the site price, we will charge the lower correct price only and will ship the product.

 

Customs

If goods ordered from Segreti Sabaudi are delivered outside Italy, they may be subject to import duties and taxes payable once the package reaches the specified destination. Any additional customs clearance costs will be borne by the customer. The Regia Compagnia has no control over these costs and cannot predict their amount. Customs policies vary significantly from country to country, and it is therefore important to contact your local customs office for further information. When ordering on the site, you are considered the importer and must therefore comply with all laws and regulations of the country in which you will receive the goods. Privacy is important to the Regia Compagnia; international customers and customers shipping abroad should be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

 

Product Warranties and Limitations of Liability

Consumers benefit from the statutory legal guarantee of conformity that the seller is required by law to provide on every sold good (“Legal Guarantee”). The Legal Guarantee covers lack of conformity with the sales contract. Where applicable, you are entitled to have the goods brought into conformity free of charge through repair or replacement, or, if that is not possible, to a price reduction or contract termination. The Regia Compagnia is liable for lack of conformity where it appears within one month from delivery. You must in any event report the lack of conformity within the prescribed term. If you identify a lack of conformity in goods purchased from the Regia Compagnia during the Legal Guarantee period, please contact Segreti Sabaudi Customer Service. To the extent permitted by law, the Regia Compagnia disclaims any liability where the delivered product does not comply with the legislation of the delivery country other than Italy. The Regia Compagnia shall not be liable for delivery delays due to insufficient stock at the supplier. The Regia Compagnia shall not be liable for non-material differences between purchased goods and their illustrative images and text descriptions published on the Segreti Sabaudi website. Except in cases of willful misconduct or gross negligence, Segreti Sabaudi is liable only for direct and foreseeable damage at the time of contract conclusion. The Regia Compagnia shall therefore not be liable for losses, lost profits, or any other damage that is not the immediate and direct consequence of our non-performance or that was not foreseeable at the time of contract conclusion. All products sold by Segreti Sabaudi are covered by the statutory legal guarantee of conformity under the Consumer Code. The legal guarantee is reserved for consumers and applies only to users who purchase for purposes unrelated to any professional, entrepreneurial, or commercial activity. For purchasers who are not consumers, the civil code warranties for defects in the sold goods, warranties for promised and essential qualities, and other civil code warranties apply with their respective terms, limitations, and forfeitures.

 

Changes to the General Conditions of Sale

The Regia Compagnia reserves the right to modify the site, policies, and these General Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. The Customer will be subject to the policies and terms of the General Conditions of Sale in force at the time products are ordered from Segreti Sabaudi, unless changes are required by applicable law or competent authorities. If any provision is deemed invalid, void, or for any reason unenforceable, that provision shall not affect the validity and enforceability of the remaining provisions.

COUPONS, GIFT VOUCHERS & SUSSURRI

 

Terms of Use for Coupons, Discount Vouchers and “Sussurri”

Discount codes and “Sussurri” issued by Segreti Sabaudi may be used exclusively for the purchase of eligible products on www.segretisabaudi.com. They are deducted from the total order amount at the time of invoicing and are available only for certain payment methods. No additional fees apply when using discount codes or “Sussurri”.

Limitations

Discount codes and “Sussurri” are valid for two years from the date of issue. They may not be used to purchase other discount codes or “Sussurri”, nor for unauthorized commercial purposes, including, by way of example, facilitating the resale or shipment of products from cantinasabauda.com.

Coupons and “Sussurri” may not be reloaded, resold, converted into cash or used in any manner otherwise prohibited by this policy. Any remaining balance of a Coupon or “Sussurri” associated with a Segreti Sabaudi account may not be transferred to another cantinasabauda.com account.

Risk of Loss

The risk of loss and ownership of discount codes or “Sussurri” pass to the purchaser at the time of electronic transmission of the Coupon or “Sussurri” to the purchaser or designated recipient, or upon delivery to the carrier, as applicable. Segreti Sabaudi disclaims all liability in the event of loss, theft, destruction or unauthorized use of discount codes or “Sussurri”.

Fraud

In the event that a Coupon or “Sussurri” is generated or obtained fraudulently, the Regia Compagnia reserves the right to close customer accounts and charge the amount of the relevant orders to alternative payment methods.

Limitation of Liability

The Regia Compagnia disclaims any express or implied warranty relating to gift vouchers, including implied warranties of merchantability or fitness for a particular purpose. In the event that a discount code fails to function, the sole remedy available shall be its replacement. Where applicable law does not allow limitations on warranties, the above limitations shall not apply and additional rights may be available.

General Provisions

The General Terms of Use and Sale of cantinasabauda.com apply. Discount codes, Gift Vouchers and “Sussurri” are issued by the Regia Compagnia.
The Regia Compagnia reserves the right to request additional information regarding the identity and ownership of Coupons, “Sussurri”, Gift Vouchers and the cantinasabauda.com account, as well as the indication of an additional payment method before adding a Coupon, Gift Voucher or “Sussurri” to a SegretiSabaudi.com account.
